May 12: Webcast - Working with Immigrants: The Intersection of Basic Immigration, Housing, and Domestic Violence Issues in California

You should attend this training if you would like to provide pro bono services to immigrant clients in the areas of housing, immigration, or domestic violence or you would like to improve your representation of immigrant clients generally. Many immigrant clients require assistance with a constellation of related yet distinct issues. This day-long program attempts to address these particular areas of overlap. Experienced practitioners in the areas of immigration, family law, and housing will share their expertise by providing insight into cultural issues that arise when working with immigrant clients, how these areas of law overlap to provide special protections and remedies to immigrants and domestic violence survivors, and how immigration status impacts eligibility for federally subsidized housing.

June 4: London - Reputational Risks for Employers - Key Legal Issues

The Jeremy Clarkson saga, recent press coverage of employers evading train fares and regular stories about inappropriate tweets highlight the reputational risks that can arise from employment issues. Inappropriate conduct in the workplace of an individual with a high external profile, misguided use of social media and misconduct unconnected with the employee's duties but which may bring the employer into disrepute, can present employers with challenging legal and reputational issues as can litigation involving newsworthy claims.
Even if the issues leading to an employee's dismissal do not attract attention immediately, the fact that they may be played out in a subsequent employment tribunal case can also cause concern since the litigation may attract untoward press attention, especially if the case involves lurid allegations.
An awareness of the legal issues which can arise, together with practical steps which can be taken to protect the employer’s position, can enable employers proactively and effectively to handle situations which can involve PR risks and potential exposure to claims.

May 20: NYC+Philadelphia+Princeton - Where Are We Now? Patent Misuse Doctrine Since Princo

This session will discuss the current state of the patent misuse doctrine in light of several novel theories recently asserted in a number of cases. It will begin with a brief background and description of the doctrine of patent misuse, including its origin and the policies that motivated its development. Next, we will discuss recent decisions from the Federal Circuit, including the 2010 en banc decision in Princo Corp. v. International Trade Commission. It will conclude with a survey of cases following Princo, in which courts have analyzed (or will soon be analyzing) various theories to determine whether those theories give rise to a viable patent misuse defense.

April 16: Webcast - Local Immigration Laws and their Impact on Hispanic/Latino Health

Federal immigration enforcement policies have been increasingly delegated to state and local jurisdictions. This shift has resulted largely from the implementation of two federal initiatives: section 287(g) of the Immigration and Nationality Act and the Secure Communities program. Some evidence suggests that both section 287(g) and the Secure Communities program contribute to Hispanic/Latino immigrants’ general mistrust of local law enforcement, as well as fear of utilizing a variety of public services and accessing health care services. This webinar will introduce new research investigating the impact these laws may have on access to care and how barriers created by immigration laws could impact health. Presenters will offer practical suggestions to help public health practitioners, health care providers and community workers address these barriers.

April 14: San Francisco - Affirmative Lawsuits in Housing #MCLE

What affirmative remedies do tenants have when there are problems with the rental dwelling and/or the landlord? While cross-complaints are not permitted in eviction actions, there are a broad range of affirmative actions available to tenants, from repair-and-deduct to civil suit for breach of warranty of habitability, constructive eviction, and several other well-established causes of action. Other less drastic options for dealing with landlord/tenant problems also exist. These tenant remedies will be the subject of this training. Fred Feller received his law degree from Georgetown University and specializes in premises liability, landlord-tenant law, and insurance defense litigation.

June 5: DC - Veterans Consortium Pro Bono Program Training

This program provides training free of charge to attorneys who agree to counsel and/or represent a veteran/VA claimant or family member before the Veterans Court. As well as receiving the day-long training, attorneys who participate are assigned a case that has been screened for merit and provided a screening memo outlining the issues in the case. Volunteers are also assigned a mentor (a practicing veterans’ law lawyer or practitioner) to give advice and share sample pleadings. Attorneys also receive the Veterans Benefits Manual (VBM) and other resource materials.
Attorneys who participate receive free training in exchange for a commitment to handle at least one appeal that is before the Veterans Court. Attorneys with little or no prior veterans’ law experience are generally able to capably represent an appellant before the Veterans Court provided they attend the training seminar and maintain contact with their mentor. Most cases can be completed in 50 to 60 hours; many cases may require fewer hours. A typical case lasts about 1 year from the time that the attorney enters the case. Some cases may be resolved more quickly and some may take longer.
These trainings tend to fill up quickly, so register asap.

April 22: Webcast - Practical and Ethical Issues in Compensating Fact Witnesses: Are the Benefits Worth the Headache?

Not only expert witnesses request payment for their time preparing for trial and their testimony, as once was the trend. Now fact witnesses with special knowledge about the case sometimes expect to be compensated as well. Although rules regarding compensation of fact witnesses have loosened over the years, such payments are not unconstrained. ABA Model Rule 3.4 (b) and the Federal Anti-Gratuity Statute provide some guidance on this topic, but have been criticized for being too vague. In this webinar, you will learn practical advice on how to structure payments to fact witnesses, how to disclose such payments to opposing counsel, and other procedures that will not only help deflect the unavoidable appearance of impropriety associated from such payments, but will also help prevent sanctions from the court.
During the webinar, we will discuss the following:
  • An overview and interpretation of rules and statutes relating to compensation of fact witnesses
  • Exemplary legal opinions dealing with such compensation

Douglas Beyerlein has over 30 years of experience in numerous aspects of water resources planning, flood studies and stormwater management. Before co-founding Clear Creek Solutions, Mr. Beyerlein worked for Hydrocomp and Anderson-Nichols in the San Francisco Bay Area. He later worked for Snohomish County Surface Water Management and AQUA TERRA Consultants in Everett, Washington. As senior hydrologic engineer and engineering group supervisor for Snohomish County, Mr. Beyerlein helped to develop the surface water management program for the county. His responsibilities included watershed planning, streamflow and water quality monitoring, lake management, public education, flood control planning, development of county drainage code, and compliance with state and federal water quality laws. Mr. Beyerlein is licensed as a registered professional engineer in Washington and California and is certified as a Professional Hydrologist by the American Institute of Hydrology. He is also a member of the American Water Resources Association and the American Geophysical Union.
