June 27: Everything Employers Should Know About the FTC Rule Banning Noncompetes and New DOL Overtime Rule

The Biden administration has been busy in recent months. First, the FTC issued its long-threatened rule banning nearly all noncompete agreements across the country. Not to be outdone, the DOL announced an increase in the minimum threshold for salaried employees from $35,568 to $43,888 on July 1, 2024, and then to $58,656 on January 1, 2025.
This webinar will provide practical answers to the following questions:
  • What legal challenges have been filed to these rules, and what are the chances they will take effect?
  • If the FTC rule takes effect, what types of agreements would be outlawed? What options are available for employers to limit post-employment competition through incentives or other means?
  • What are other state and federal actors doing to limit the enforceability of noncompetes?
  • What options are available for employers to comply with the changes to the minimum salary threshold under the FLSA?
  • Can employers take credit for bonuses and incentives to meet the new threshold?
  • What are the practical considerations in converting salaried exempt employees to an hourly rate?
