On Feb. 28, 2022, the U.S. Supreme Court will hear oral arguments in West Virginia v. Environmental Protection Agency, the latest legal challenge to the EPA’s authority to regulate greenhouse gas emissions under the Clean Air Act. The central issue in the case is the scope of the agency’s authority to control greenhouse gas emissions from the power sector, and whether EPA regulations may rely upon or require broader changes in the utility sector to reduce emissions.
In addressing this issue, the Court has been asked to consider the “major questions” doctrine, and a resulting decision could have far-reaching implications for climate policy, environmental law and the continued vitality of the federal administrative state.
