Susie Ruth Powell ('73), the Law School’s 2020 Centennial Medal winner and co-author of the Emmy-award-winning HBO documentary, “The Loving Story,” will discuss her career in poverty law and the important cases she litigated. Professor Powell was co-author of the Emmy award-winning documentary, “The Loving Story,” and a story developer for the documentary "The Rape of Recy Taylor.” She will be this year’s recipient of The Centennial Medal Award, the highest honor bestowed upon a CWRU Law graduate.

Susie Ruth Powell is a retired legal aid attorney and assistant professor at North Carolina Central University School of Law. She received her Juris Doctor from Case Western Reserve University in 1973 in the first wave of women law students and was one of two black women to graduate in that class. Some career highlights include suing the United States on behalf of poor people living in substandard federal housing in the case Garden Valley Tenants Association v. James Lynn and The United States of America, practicing poverty law in North Carolina by grappling with issues of housing, domestic violence, food stamps, child care and tort defenses, and teaching contracts, trial practice and legal writing at North Carolina Central University School of Law and teaching at the legal clinic at NCCU. Powell has an Honorary Doctor of Humane Letters from Bennett College for Women, an Honorary Doctor of Laws from North Carolina Central University, and served as a writer on the Emmy Award-winning documentary, “The Loving Story,” which earned Historians' top prize, among a number of prizes. She also worked on the story development for “The Rape of Recy Taylor,” her second documentary film.

December 29: Leveraging Technology to Prepare Briefs with Greater Efficiency and Accuracy

September 16: Representative Selection and Extrapolation of Construction Defects.

Expert consultant opinions are rooted in observational data and drive construction defect (CD) litigation. However, experts often only look at or test a few locations rather than 100% of the locations. This means experts are using a small sample size to extrapolate conclusions about the overall population and the project. Looking at the math, there is nothing inherently wrong with this.... At least not in theory. Unfortunately, construction defect litigation frequently uses biased data to extrapolate. This course hopes to correct this trend by teaching the correct way to select and extrapolate data for CD litigation.

December 16: Terminating a Construction Project Before Completion: Do's, Don'ts, Claims, & Litigations

Construction is expensive, and the professionals who complete it can vary wildly in quality. While some professionals uphold the industry’s gold standards, others can be disappointing at best and criminally negligent at worst. In these cases, a judgement call must be made to terminate a project prior to completion. Unfortunately, this process is usually expensive and complicated. It is possible to ease the stress of ending a project by using a standard structure that considers the contract documents, construction industry standards, and the “iron triangle” (scope, budget, and schedule). This structure does not magically make termination quick and cheap, but it does make the process as efficient and painless as possible. No matter what stage of a construction project gone bad you are in, remember you are not trapped if you negotiate from a position of strength. "Terminating a Construction Project Before Completion" is for everyone involved in the buildings business, including owners, attorneys, adjusters, property managers, real estate professionals and anyone else caught up in the headaches of a terminated project. Increasing numbers of people are filming police activity including police misconduct. Some people film because they happen upon police activity. Other people, known as First Amendment auditors, actively seek to film the police and other public (and private) officials to educate the public that photography in public is not a crime.

August 25: Allocation of Responsibility of Construction Defects

"Allocation of Responsibility for Construction Defects"
is for everyone who needs to understand how the costs of construction defect allegations should be distributed to responsible parties. The program is for construction, insurance, legal, and property professionals; particularly those who regularly deal with construction defect litigation. The process for allocating responsibility of construction defect allegations is mostly a science, but some critical parts include the “art” of applying professional judgment. The program will outline the mechanics of those judgment calls. This includes making a sensible list of defects which can be allocated, assigning values to each defect issue or category, making a list of all possibly involved parties and understanding their role in the project, and assigning justified portions of responsibility for each issue.
