June 8: Ethics, the Press and your Practice: Getting out there without getting into trouble

The reporter covering your case for a national media outlet calls. They’d like a detailed quote for the piece they’re working on. You’re eager to tell your client’s side of the story – but worried about getting stung. You don’t want to leave the other side’s statement without a counterstatement, allowing them to set the narrative, but you aren’t sure how to best present your client’s case publicly in a way that protects both you and the client.
For attorneys looking to elevate their profile and influence public opinion on a specific matter or case, partnering with the press can provide real benefits. However, as seasoned practitioners and communications industry experts know, there are very specific rules of engagement for attorneys who speak to the press and failing to follow them can cause damage to the attorney, client, and ultimately the case. Even inadvertent mistakes can leave an attorney open to risks from ethics violations to defamation.

The discussion will include specific attention to ethical rules – including ABA Model Rule of Professional Conduct Rule 1.6 and 3.6, concerning confidentiality and trial publicity, respectively, to provide practical and actionable takeaways for attorneys as they balance skillful press interactions with ethical considerations and other risks.

Speakers:
Eleanor Tyler is a Legal Analyst on Bloomberg Law’s Litigation team, with a focus on antitrust. Previously, she spent seven years reporting for Bloomberg Law's antitrust news desk. Before joining Bloomberg Law in 2010, Eleanor was a litigation associate at a large law firm. She clerked for the Hon. Simeon Lake in the U.S. District Court for the Southern District of Texas. Her JD is from Georgetown University, and she holds an MA in international affairs from Johns Hopkins SAIS.
Fawn Johnson currently manages a team of reporters covering health policy in the Bloomberg Law newsroom. Other managing editor roles covered antitrust law, corporate law, telecommunications, finance, and Congress. Before becoming an editor, she spent the better part of 20 years as a reporter covering several federal policy areas for National Journal, the Wall Street Journal, CongressDaily, and the pre-Bloomberg-owned BNA.
