October 4: ESG and the Climate: Emerging Risks & Compliance

This course will provide an introduction of environmental, social and governance (ESG) considerations for both experienced and newer attorneys. We will examine the current legal framework in the United States and emerging issues related to compliance with newly released SEC climate disclosure rules. We’ll also examine the historical context of how federal and state agencies enforce topics such as ESG, and the potential for litigation on these issues in the future.

With data security incidents and data breaches happening daily, it’s important for attorneys to turn towards one reality—it’s NOT IF a breach or incident will occur—it’s WHEN. 
These incidents are forcing government agencies, companies, law firms, etc. to address, define, and handle these challenges. September 21: Biden Administration Update: Big Developments on the Labor Front

In the last few weeks, the Biden administration has been busy shaking up the world of labor and employment law. First, in a one-two punch, the National Labor Relations Board (NLRB) issued a proposed rule to speed up elections, followed by a groundbreaking decision turning the election system on its head – effectively allowing card checks and requiring employers to petition for an election instead of a union. Not to be outdone, the Department of Labor recently issued a proposed rule that would increase the minimum salary threshold under the FLSA from approximately $35,000 per year to $55,000.

September 20: The Lopsided Law of Medical Conscience

We’re used to hearing about conscientious refusers, as when clinicians or institutions summon religion to deny services they deem sinful or wrong. Less familiar are conscientious providers, compelled to help make patients better, keep them well and relieve their suffering. 
Our medical conscience system protects refusers alone. When doctors or nurses deny care by appeal to their heartfelt convictions, conscience laws shield them from being not only fired but sued for malpractice or prosecuted for endangering patients or abandoning them. But clinicians who have equally sincere and moral reasons deliver services their hospital or state forbids go virtually unprotected. This radical asymmetry is wholly exceptional, indefensible, and unjust.
It’s easy to assume that being forced to do something like treat against your will is worse than not being allowed to undertake such treatment. This distinction between acts and omissions looms large in life and law. But it has less purchase in the context of medicine, where clinicians owe patients affirmative duties like disclosing key information and avoiding unreasonable harms. 
Nor need the delivery of care cost more to accommodate than its denial. The price of furnishing painkillers, birth control and other pills is just a telehealth appointment and prescription pad. It’s not as if refusals are costless. They can delay urgent care like emergency contraception and force hospitals to recruit backup staff. 
Religion can’t justify the asymmetry, either. Conscience clauses vindicate secular beliefs just the same. And some conscientious providers themselves appeal to a spiritual calling. The law should make at least as much space for their conscience as refusers’.

September 21: Labor-Based Deferred Action Training for Lawyers, Investigators and Community Advocates

In January 2023, the U.S. Department of Homeland Security created a new pathway to work authorization and temporary protection from deportation for workers involved in a labor dispute at their workplace. Through the new program, workers can now request deferred action after a labor investigation agency submits a Statement of Interest.
The purpose of the process is to promote fairness, safety, and a level playing field for all workers in the U.S. by strengthening labor agencies’ ability to enforce labor and employment standards.
The Binger Center for New Americans has partnered with The Advocates for Human Rights, the American Immigration Lawyers Association, the Minnesota Office of the Attorney General and the Minnesota Department of Labor and Industry to convene lawyers, labor investigators and community advocates to learn more about labor-based deferred action. The training will include an overview of the deferred action process, an explanation of how each group plays a key role in the process and a chance to explore ways to collaborate to ensure eligible workers receive the support they need to apply.

October 11: The Future of Noncompetes: Balancing Business Interests and Regulatory Shifts

With noncompete agreements falling into disfavor with regulators on many levels, how can in-house counsel best protect their clients’ business assets? What types of restrictive covenants – or other types of restrictions – will survive the Federal Trade Commission’s proposed Non-Compete Clause Rule and the National Labor Relations Board’s opinion that certain noncompete agreements violate federal labor law? September 11+13: Eliminating Bias in the Legal Profession

The goal of this CLE presentation is to discuss bias and where it comes from; why it is harmful; how to detect it and how to eliminate it from our behavior as legal professionals. Practicing law is a bias landmine. From whether we believe a witness or opposing counsel; to how we counsel those in our organization we readily apply judgments to others — coloring our perceptions and thoughts. There is no cure for bias, but you can be more mindful, conscious and monitor your thoughts better. These are the four main questions we will answer in our discussion today: What is bias? What are unconscious and confirmation biases? What are the effects and costs of bias? And, finally how can we avoid bias through thinking about our thinking and implementing best practices?
