In the last few weeks, the Biden administration has been busy shaking up the world of labor and employment law. First, in a one-two punch, the National Labor Relations Board (NLRB) issued a proposed rule to speed up elections, followed by a groundbreaking decision turning the election system on its head – effectively allowing card checks and requiring employers to petition for an election instead of a union. Not to be outdone, the Department of Labor recently issued a proposed rule that would increase the minimum salary threshold under the FLSA from approximately $35,000 per year to $55,000.
