June 29: Trends to Watch in Energy Law

April 27: A Draft Indictment: A Roundtable Discussion about Russian War Crimes in Ukraine

In the six weeks since Russia invaded Ukraine, the world has witnessed photos and videos of shocking atrocities. There have been calls to prosecute Russian President Vladimir Putin for war crimes before the International Criminal Court.
In this hour-long online program, Michael Scharf, co-dean of Case Western Reserve University School of Law and host of Public Radio’s “Talking Foreign Policy,” moderates a conversation about accountability for war crimes in the Ukraine.

  • Milena Sterio, professor, Cleveland Marshall College of Law and managing director, Public International Law and Policy Group, who is leading an initiative to document war crimes in Ukraine;

April 25: It’s Complicated: Facebook’s Liability for Users’ Posts

Facebook lets users describe their relationship status as “it’s complicated,” but it also enables them to commit fraud, harassment, and invasion of privacy, or to spread all kinds of disinformation, defamation, and intimate images. When is Facebook (or any other platform) legally responsible for users’ bad behavior? When should they be? The current answer is found mostly in a federal statute, 47 U.S.C. § 230, that immunizes online intermediaries from liability for most user-generated content. Section 230 is the subject of constant controversy and numerous reform proposals, but has remained largely intact since 1996. Is it time to change it? If so, how?
In this Continuing Legal Education webinar, Minnesota Law’s William McGeveran, Associate Dean for Academic Affairs and Gray, Plant, Mooty, Mooty & Bennett Professor of Law, will moderate a conversation with two of the nation’s foremost experts on Section 230 and explore both its history and its possible futures:
  • Danielle Citron, the Jefferson Scholars Foundation Schenck Distinguished Professor in Law and Caddell and Chapman Professor of Law at the University of Virginia, was named a 2019 MacArthur Fellow (colloquially known as the “genius award’) for her work on cyberstalking and intimate privacy. Her book Hate Crimes in Cyberspace (2014) was a call to action against gender-biased online harassment. Professor Citron has written extensively about legal culpability for online platforms, most recently in a forthcoming Boston University Law Review essay, “How to Fix Section 230,” and in her upcoming book, The Fight for Privacy: Protecting Dignity, Identity, and Love in the Digital Age.
  • Jeff Kosseff, Associate Professor of Cybersecurity Law at the United States Naval Academy, wrote the seminal book on Section 230, The Twenty-Six Words that Created the Internet (2019). He received a 2019 Andrew Carnegie Fellowship and frequently writes, speaks, and testifies in Congress about the regulation of online speech. Professor Kosseff is also the author of the first comprehensive textbook on U.S. cybersecurity law, and he just published a new book, The United States of Anonymous: How the First Amendment Shaped Online Speech. Before his academic career, he practiced cybersecurity and privacy law, and prior to law school he was a journalist for The Oregonian, where he was a finalist for the Pulitzer Prize for national reporting.

April 22+29: The Emergent Right to Repair

In years past, consumers didn’t think twice about taking a broken car or toaster to a local repair shop or even fixing it themselves. But with today’s software-enabled products, consumers can no longer take those options for granted. In response to legal and technological restrictions, a growing movement advocating a right to repair has emerged, despite pushback from some quarters.
The right to repair is at the center of a key policy debate. The Biden Administration and a unanimous FTC recently voiced support for competition and consumer choice in repair markets. Legislation under consideration in dozens of states would facilitate consumer and third-party repair. And regulators around the world have begun to embrace the repair agenda. But manufacturers and device makers remain skeptical of an unfettered right to repair, citing concerns over intellectual property rights, reliability, security, and lost revenue.
This symposium will consider the complex, overlapping set of policy questions at the center of the repair debate. How do restrictions on repair, or their elimination, affect competition? How might policymakers resolve potential tensions between the right to repair and the intellectual property rights of device makers? Would the consumer benefits of open repair markets outweigh their risks? And what legislative solutions or other policy interventions are best-suited to address these questions?

April 19: The Vincent Chin Trial Re-Enactment and Panel

In 1982, at the height of anti-Japanese sentiment, Chinese-American Vincent Chin was murdered in Detroit by two white autoworkers who said, "it's because of you mother** that we're out of work."
Two assailants beat him with a baseball bat, matching their physical violence with a stream of racial epithets. He died shortly before what would have been his wedding day.
When the Wayne County Circuit Judge fined the killers a mere $3,000 and three years probation, Asian Americans around the country galvanized for the first time to form a real community and movement. Organizers took their concerns to the federal government, arguing that Vincent Chin was targeted and ultimately killed because he was an Asian American. The ensuing case marked the first time the federal government ever pursued a civil-rights claim on behalf of an Asian American person.
On Tuesday, April 19th, APALSA will honor not only Vincent Chin, but also the memory of countless victims of Anti-Asian violence. Please join us for the Trial Re-enactment of the Vincent Chin case, featuring Judge Denny Chin, Kathy Chin, FLS faculty, and students. After the trial, Professors Bennett Capers and Thomas Lee will lead a panel discussion about the resurgence of anti-Asian violence in the city. Reception to follow on Murphy Terrace.

He teaches and writes in the area of constitutional law and is the author of The Schoolhouse Gate: Public Education, the Supreme Court, and the Battle for the American Mind. The book was selected as a Washington Post Notable Book of the Year and an Editors’ Choice of The New York Times Book Review. The Schoolhouse Gate also received the Steven S. Goldberg Award for Distinguished Scholarship in Education Law, and was a finalist for the American Bar Association’s Silver Gavel Award and Phi Beta Kappa’s Ralph Waldo Emerson Book Award.
A recipient of the American Society for Legal History’s William Nelson Cromwell Article Prize, Driver has a distinguished publication record in the nation’s leading law reviews. He has also written extensively for general audiences, including pieces in Slate, The Atlantic, The New York Times, The New York Times Book Review, The Washington Post, and The New Republic, where he was a contributing editor. A member of the American Law Institute and of the American Constitution Society’s Academic Advisory Board, Driver is also an editor of the Supreme Court Review. April 14: The Constitutionalization of Human Rights Law and its Impact on Asylum-Seekers

The constitutionalization of human rights law is on the rise throughout the world. With increasing frequency, countries have either adopted specific human rights provisions or incorporated entire human rights treaties into their national constitutions. While this phenomenon has received much scholarly attention in the abstract, we know virtually nothing about how it affects asylum-seekers in particular. In his talk, Professor Meili will analyze how lawyers representing asylum-seekers in five countries (Colombia, Mexico, South Africa, Uganda, and the United States) have bridged the gap between lofty words on parchment and the protection of asylum-seekers on the ground. In doing so, he will analyze the factors that contribute to the effective use of constitutionalized human rights law in the refugee context, and those which detract from it. He will also highlight the importance of this issue in the current moment, as many refugee-receiving nations ignore their obligations under international law, making domestic law – and national constitutions in particular - an increasingly important vehicle for the protection of refugee rights.

What can histories of modern Black media arts teach us about human expressive cultures and the importance of peaceful coexistence? How has art and media served as an instrument of response to the calamities of conflict and as means to articulate strategies of resolution, reconciliation, and solidarity? This presentation explores this topic by examining how Dr. Maya Angelou's philosophical insights about peace and love, and scholar Saidiyah Hartman’s critical interventions within legal studies and archival studies, have been taken up in the work of Black media-makers and artists.

Robeson Taj Frazier 
Robeson Taj Frazier is an associate professor of communication in the Annenberg School for Communication and Journalism at the University of Southern California. He is the director of doctoral studies and director of IDEA (the Institute for Diversity and Empowerment at Annenberg). He is the author of two books, a multimedia/film producer, and has published articles and essays about U.S. Black social movements and political ideologies, globalization, fine arts, popular culture and U.S.-China relations and cultural contact.
His most recent book, KAOS Theory: The Afrokosmic Ark of Ben Caldwell (Angel City Press, 2023), explores the creative contributions and philosophical insights of Los Angeles filmmaker and multimedia artist Ben Caldwell and the community arts organization he founded, KAOS Network. Frazier's first book, The East is Black: Cold War China in the Black Radical Imagination (Duke University Press, 2014), analyzes the political and cultural ties cultivated between China and U.S. Black political movements during the Cold War, and the role that travel, media and representation played in this process. His second project, It’s Yours: A Story About Hip Hop and the Internet (2019), is a documentary film that examines how hip-hop artists’ and the broader global hip-hop community’s use of the Internet and digital technologies has revolutionized the music industry and global youth culture.
