September 18: The Growing Consumer Exposure to Nanotechnology in Everyday Products: Regulating Innovative Technologies in Light of Lessons from the Past by Creating a “Public Health Product Safety Net”

This presentation will broadly touch on the public health, regulatory, legal, and ethical issues raised by the developing appreciation of the health risks associated with nanotech products. More specifically, the following will be covered:
(1) the present scientific understanding of the health risks associated with the consumption of nanoparticles;
(2) the existing FDA regulatory structure that governs food, dietary supplements, cosmetics and sunscreens and whether these regulations adequately protect public health when applied to the nanotech versions of these products;
(3) whether the tort system can provide a remedy for a consumer who is injured from unavoidable exposure to nanotech ingredients; and
(4) a proposal for an alternative method of regulating nanotech products that protects public health while encouraging technical innovation through the use of big data strategies to animate the “public health product safety net.”

August 14: Trade War with China and Emerging Technology Export Controls

The United States and China are locked in an epic trade battle. The U.S. Administration is using the full range of tools in its arsenal, including a 25% tariff on Chinese imports, unfair trade practice investigations for certain industries, adding companies to the export ban list, a ban on procurement of Chinese IT by federal contractors, pending export controls relating to emerging technologies such as AI, robotics and big data, and an Executive Order that provides a basis for import bans and further restrictions.
Melissa Duffy, a partner in Dechert’s Washington office who focuses on international trade matters, will discuss recent developments in U.S.-China trade war, with a particular focus on tariffs and emerging technology export controls. Presenters:
  • David Kleiman is Senior Product Manager at Bloomberg Law, focused on delivering tools and analytics for litigation attorneys. He was previously a litigator at Arnold & Porter LLP and law clerk for a federal district court judge. David has written on the topic of demystifying AI for lawyers through supervised machine learning.
  • Christian Mammen has been litigating patents and technology cases since the start of the first dot.com boom in the late 1990s. His experience spans cellular communications, microchips, HD video compression, high-temperature superconductors, bio-pharmaceuticals, and even an early patent for online pizza-ordering. He has led both large and small litigation teams and has substantial first-chair experience, including arguing Markman hearings, arguing summary judgment hearings, taking and defending key technical and patent law expert depositions, and arguing before the U.S. Court of Appeals for the Federal Circuit.
  • Mindy Rattan is the litigation team lead in the Analysis unit at Bloomberg Law. She is responsible for developing the litigation-related content on the Bloomberg Law platform. Before assuming that role, Mindy was a legal ethics reporter for Bloomberg Law. She practiced law for 16 years as a commercial litigator. She also counseled colleagues and clients regarding legal ethics issues. She has presented numerous programs both for the ABA's Center for Professional Responsibility and the DC Bar about ethical issues faced in the practice of law, including ethical issues relating to social media and cloud computing, and ethics and integrity. Mindy is a past Chair of the ABA's Center for Professional Responsibility's CLE Committee.
  • Arlene Zalayet is senior vice president, general attorney and manager of the Field Legal Organization for Liberty Mutual Group. In that capacity, she oversees 1,600 staff members and is responsible for the management, organizational structure, and talent of staff counsel in 68 offices within 38 states. The offices represent Liberty Mutual and its policyholders in a variety of legal matters including personal injury defense, worker’s compensation, construction defect, subrogation, and fraud investigations. Ms. Zalayet’s responsibilities include workforce management, office administration, financial efficiencies, quality assurance, and client services satisfaction.
